Terms of Service

These Terms of Service ("Terms") govern your use of the PhaseCoach platform operated by PhaseCoach ("we", "us", "our"). By creating an account or using PhaseCoach, you agree to these Terms.

1. Service Description

PhaseCoach is a software platform that provides tools for personal trainers and coaches ("Coaches") to manage their clients, track progress, and deliver nutrition, training, and supplement protocols. PhaseCoach also provides a mobile application for clients to log daily data, view plans, and communicate with their coach.

2. Beta Disclaimer

PhaseCoach is currently in beta. The service is provided "as is" and "as available" without warranties of any kind, express or implied. We do not guarantee uptime, data persistence, or uninterrupted service. Features may change, be added, or removed at any time during the beta period.

3. Account Responsibilities

  • You must provide accurate information when creating your account.
  • You are responsible for maintaining the security of your login credentials.
  • You must not share your account or allow unauthorized access.
  • You are responsible for all activity under your account.
  • You must be at least 18 years old to use PhaseCoach.

4. Coach Responsibilities & Liability Separation

PhaseCoach is a tool, not a coaching provider. Coaches using PhaseCoach are independent professionals. They are solely responsible for:

  • The accuracy, safety, and appropriateness of all protocols, plans, and advice they deliver
  • Holding appropriate qualifications, certifications, and professional insurance
  • Complying with all applicable laws and regulations in their jurisdiction
  • Obtaining informed consent from their clients
  • The coach-client relationship and any outcomes arising from coaching

PhaseCoach has no oversight over, and accepts no liability for, the content, quality, or safety of any coaching, protocols, or advice delivered through the platform.

5. Health & Medical Disclaimer

PhaseCoach does not provide medical, nutritional, or fitness advice. All content on the platform is created by coaches or users, not by PhaseCoach. Nothing on PhaseCoach should be considered a substitute for professional medical advice, diagnosis, or treatment.

  • Always consult a qualified healthcare professional before starting any exercise, nutrition, or supplementation program.
  • If you experience any adverse health effects, stop immediately and seek medical attention.
  • PhaseCoach is not liable for any injury, illness, or adverse outcome resulting from the use of protocols or plans on the platform.

6. Enhanced Features Disclaimer

PhaseCoach includes optional features for tracking performance-enhancing compounds and cycles. These features are informational tools only.

  • PhaseCoach does not endorse, promote, or encourage the use of any controlled or prohibited substances.
  • Users who enable enhanced features do so entirely at their own risk.
  • PhaseCoach accepts no responsibility for any legal, health, or other consequences arising from the use of enhanced features.
  • Users are solely responsible for compliance with all applicable laws regarding any substances they choose to use.

7. Limitation of Liability

To the maximum extent permitted by law, PhaseCoach and its owners, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

  • Loss of data, revenue, or profits
  • Service interruptions or downtime
  • Errors, bugs, or inaccuracies in the platform
  • Any injury, illness, or adverse outcome from using the platform
  • Unauthorized access to your account or data

Our total liability for any claim arising from your use of PhaseCoach is limited to the amount you have paid us in the 12 months preceding the claim, or £100, whichever is greater.

8. Indemnification

You agree to indemnify and hold harmless PhaseCoach, its owners, employees, and affiliates from any claims, damages, losses, or expenses (including legal fees) arising from your use of the platform, your violation of these Terms, or your violation of any third-party rights.

9. Account Termination

We reserve the right to suspend or terminate your account at any time, for any reason, with or without notice. Reasons for termination may include but are not limited to violation of these Terms, abusive behaviour, or suspected fraudulent activity.

You may close your account at any time by contacting us. Upon account closure or termination, we will delete your data in accordance with our Privacy Policy.

10. Intellectual Property

The PhaseCoach platform, including its design, code, and branding, is owned by PhaseCoach. You retain ownership of any content you create on the platform (plans, messages, logs). By using PhaseCoach, you grant us a limited license to store and display your content as necessary to provide the service.

11. Governing Law

These Terms are governed by the laws of England and Wales. Any disputes arising from these Terms or your use of PhaseCoach shall be subject to the exclusive jurisdiction of the courts of England and Wales.

12. Modifications

We may update these Terms at any time. We will notify registered users of material changes via email. Continued use of PhaseCoach after changes constitutes acceptance of the updated Terms. If you do not agree with any changes, you should stop using the platform and close your account.
